These Terms of Service (“Terms”) govern your access to and use of the FOREX-TRADING.ME website (the “Site”) and any related services provided by FOREX-TRADING.ME (“we,” “us,” or “our”).   • Total Liability Cap: OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE SITE SHALL NOT EXCEED THE AMOUNT PAID BY YOU (IF ANY) FOR ACCESS TO THE SITE IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR, IF NO SUCH AMOUNT WAS PAID, ONE HUNDRED DOLLARS (U.S. $100).
  • Disclaimer of Warranties: THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

11. Indemnification

You agree to defend, indemnify, and hold harmless FOREX-TRADING.ME and its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees and court costs) arising out of or relating to:

  1. Your use or misuse of the Site.
  2. Your violation of these Terms or any applicable laws or regulations.
  3. Any content you submit, post, or transmit through the Site.
  4. Allegations that your content or conduct infringes the intellectual property, publicity, privacy, or other rights of any third party.

12. Termination

We may, in our sole discretion, suspend or terminate your access to all or part of the Site at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or our business. Upon termination, your right to use the Site will immediately cease. Sections 6 (Intellectual Property), 7 (Content Disclaimer), 10 (Limitation of Liability), 11 (Indemnification), and 13 (Governing Law) shall survive termination of these Terms.

13. Governing Law and Dispute Resolution

  • Governing Law: These Terms shall be governed by and construed in accordance with the laws of UK, without regard to its conflict of laws principles.
  • Dispute Resolution: Any dispute arising under or in connection with these Terms shall be resolved through good-faith negotiations between the parties. If we are unable to resolve the dispute informally within thirty (30) days, either party may pursue any legal or equitable remedy available under applicable law. You agree that any cause of action arising out of or related to the Site must commence within one (1) year after the cause of action accrues; otherwise, such cause of action is permanently barred.

14. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of the remaining provisions.

15. Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term. Failure to enforce any provision under these Terms is not a waiver of our right to subsequently enforce that or any other provision.

16. Entire Agreement

These Terms, together with any documents or policies expressly incorporated by reference (including the Privacy Policy, Cookie Policy, Risk Warning, and Advisory Warning), constitute the entire agreement between you and FOREX-TRADING.ME with respect to the Site and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written.
